Court fines Ogun CP, five others N25m for unlawful detention

For the illegal arrest and imprisonment of one Sunday Mafe, a High Court of Justice in Ogun State, Abeokuta Judicial Division, ordered N25 million in damages against the office of the Ogun State Commissioner of Police and five other parties.

As to the ruling signed by Justice E.O. Osinuga on Monday, February 5, 2024, and obtained on Tuesday, April 2, 2024, the court determined that Mafe's repeated incarceration by Nigeria Police Force personnel violated his fundamental human rights.

Additionally, the judge determined that the multiple detentions of the applicant, Mafe, from December 2 to 5, 2016, December 16 to 20, 2016, and December 23 to 29, 2016, were unlawful, unconstitutional, and without legal justification.

The detentions were based on a petition written by lawyer Yomi Nuberu on behalf of a Chief Sakirudeen Olufowobi regarding a civil and land matter over which the police lacked jurisdiction.

Sunday Mafe, the applicant, and the Commissioner of Police, Ogun State; former Area Commander, Ijebu Ode, Assistant Commissioner of Police, Funsho Ajao (retd.); Team Leader Eleweran, Inspector Rotimi; Team Leader Eleweran, Supol Nurudeen Ayinla; Team Leader, Igbeba, Inspector Gbenga Folorunso; and Team Leader, Igbeba, Inspector Wasiu Tijani were involved in the case with suit number HCJ/150/2017.

The application was filed due to the applicant's fundamental human rights as guaranteed by Sections 34 and 45 of the 1999 Constitution, as amended, as well as the violation of Section 125A Criminal Code, CAP C38.

In the lawsuit brought by Kayode Oshiyemi, Mafe claimed that the Nigerian Police Force personnel had repeatedly arrested him in December after receiving a written petition.
